In federal court, there is a presumption a person will be released from custody unless the federal prosecutor can demonstrate that the person is a threat or a flight risk.

Request for him to leave are being heard from many fellow Republicans but Idaho Senator Larry Craig maintains that the only thing he had done wrong was to plead guilty after a government complaint was filed alleging lewd conduct in men's restroom in a Minneapolis airport. Craig entered a plea of guilty to a disorderly conduct charge and in exchange the court dismissed the charge of gross misdemeanor interference to privacy.

When you are convicted of a committing a felony or misdemeanor crime, you may be sentenced to probation. Probation is generally a way to suspend custody, either jail or prison. Individuals placed on probation are free to return to their homes and communities instead of being incarcerated.

Vandalism is when a person maliciously defaces with graffiti or other inscribed material, damages or destroys real or personal property of another. It is a crime that depending on the value of the damages could be filed as a misdemeanor or a felony. In California, it could be filed as a felony if the damage is valued at over $400 and the defendant has a prior criminal record.
