I have been arrested, now what?

In majority of criminal cases in state court, a person is entitled to have a bond set so that he may get out of jail pending the resolution of his case. In federal court, there is a presumption a person will be released from custody unless the federal prosecutor can demonstrate that the person is a threat or a flight risk.

‘Lawyering up’ to fight the debt collectors

I had a client come in to my office having read about my many years of being a prosecutor in Los Angeles and wanted to know if I can help him with a summons and complaint filed against him by a credit card company. I have and continue to work on many “white-collar” crimes, including but not limited to, embezzlement, forfeiture, fraud, in both the federal and state level.

Idaho senator Larry Craig wants to withdraw his guilty plea and the burden of proof that will be required

Request for him to leave are being heard from many fellow Republicans but Idaho Senator Larry Craig maintains that the only thing he had done wrong was to plead guilty after a government complaint was filed alleging lewd conduct in men's restroom in a Minneapolis airport. Craig entered a plea of guilty to a disorderly conduct charge and in exchange the court dismissed the charge of gross misdemeanor interference to privacy.

What Happens If You Violate Your Probation?

When you are convicted of a committing a felony or misdemeanor crime, you may be sentenced to probation. Probation is generally a way to suspend custody, either jail or prison. Individuals placed on probation are free to return to their homes and communities instead of being incarcerated.

Vandalism

Vandalism is when a person maliciously defaces with graffiti or other inscribed material, damages or destroys real or personal property of another. It is a crime that depending on the value of the damages could be filed as a misdemeanor or a felony. In California, it could be filed as a felony if the damage is valued at over $400 and the defendant has a prior criminal record.
