I would like to state that this is a rare occurrence but unfortunately, it is not.

As many individuals who are paying child support are well aware, the laws in this area are highly regulated and public policy supports active collection of the money for the care of a minor child. The reach of the government is very broad. For example, they can garnish your wages, intercept tax refunds, lottery winnings and failure to pay can mean negative reports on your credit and non-renewal of your passport. Many assume that back due child support payments (“arrears”) are dischargeable in bankruptcy court. This is not true. This debt is due until paid in full or a waiver (for non-assigned arrears only).

“Arrears” means past due support. Arrears are created when a child support order is made and there have periods of time in which support payments were paid only partially or not at all. Section 685.020 (b) of the California Code of Civil Procedure mandates interest on arrears at a legal rate of 10% as each payment becomes due. This has been the law since January 1, 1984.
Calling The Police

The public is always afforded the right to call the police. 911 is a service meant for emergencies. It should be reserved for reporting a crime in progress, situations in which imminent danger to human life or other incidents deemed as emergencies exist. However, there are situations when individual(s) call the police as a means to instill fear in the recipient. We have heard it many times, “if you do not stop, I will call the police.” What many of us do not understand is the consequence of calling the police.

Attorney-client privilege is the right of clients to refuse to disclose confidential communications with their lawyers, or to allow their lawyers to disclose them. It is the client’s privilege, not the lawyer’s. It is fundamental to preserve the constitutionally based right to effective assistance of legal counsel. This protection encourages open and honest communication between clients and attorneys.

Notable legal enactments: the lowering of the unlawful blood alcohol level, the addition of a statute prohibiting DUI while driving a commercial vehicle, enhanced penalties for DUI with a minor in the vehicle or the requirement that ignition interlock devices be installed in offender’s vehicles are some examples of both the public and legislative demands for stricter penalties.
